The Uniform Directed Trust Act

Context, content and critique.

The trust relationship is a creature of equity, not statute. So is the office of trust protector or trust director. In 2017, the National Conference of Commissioners on Uniform State Laws approved the Uniform Directed Trust Act (UDTA). Let’s review general equity doctrine that’s been governing directed trusts and that presumably will continue to govern them in non-UDTA jurisdictions. In addition, I’ll address how equity doctrine applicable to directed trusts would be altered
