For civil litigators, the concept of mediation is probably not novel — but mediation has come slowly as a means of resolving probate and trust disputes. Perhaps it's because many such disputes involve more than just money. Maybe it's because resolving these disputes often involves modifying estate plans that were not created by the parties to the dispute but must be changed to suit them rather than effectuate the decedent's intent.
