With the recent election behind us, uncertainty still looms in the realm of tax reform. As we begin 2025, the future of federal transfer tax exemptions is unknown. Under the Tax Cuts and Jobs Act of 2017 (TCJA), these exemptions are at a historic high of $13.99 million. See “Historical Federal Transfer Tax,” p. 21.

While transfer tax exemptions have never decreased,1 many provisions of the TCJA, including the exemption amount, are scheduled to sunset on Jan. 1, 2026. Without further tax legislation, transfer tax exemptions could be halved to approximately $7 million.
